Changes to the divorce procedure April 6, 2022
April 2022 saw the 1st modernisation of divorce in over 50 years. The shakeup saw the procedure become more straightforward. In particular, it introduced the concept of “no blame divorce“. This change means that rather than having to provide evidence to the court for 1 of 5 grounds to justify your divorce (e.g. desertion, unreasonable behaviour and adultery) all you need now do is simply state that the your marriage has “irretrievably broken down”.
And in addition, for the 1st time, a husband and wife can also apply for a divorce together. Contested divorces have also been abolished. and terminology has been updated – so Decree Nisi becomes a Conditional Order and Decree Absolute is now known as a Final Order
These updates also apply to the dissolution of civil partnerships.
