How does family mediation help children ?
Where children are involved, it’s important for them to be able to see that their parents are co-operating and helping the family to move forward as a unit rather than bickering and struggling to come to an agreement.
The mediation process is usually very successful in showing the children that despite the family breakup, their parents can get on together and work together to agree on future arrangements. This is incredibly important for children, especially teenagers and older children.
Family Mediation –how does it work
Mediators are trained to remain impartial throughout. Their job is to help you move on from the marriage with an arrangement which is fair to everyone.
The following is what typically happens during mediation:
- Your mediator arranges meet up sessions with you and your partner – usually a couple of hours long. The number of sessions needed depends on your personal circumstances
- Your independent lawyers are not usually present during the mediation process itself . However at any time you can take a break and seek legal advice, and at no point will you be forced to make a decision that you are not comfortable with
- The mediator acts as a 3rd party intermediary, listening to both parties individually. As they are entirely impartial your mediator will put forward solutions for you to consider.
In order for an agreement to be made about finances, the mediator has to be given all of the relevant documents and information to help him or her work towards an agreement. Full financial disclosure is a legal requirement, and is essential for a fair agreement to be reached.
With the help of the mediator you then try to negotiate a financial settlement until you are both happy. The mediator can formalise any agreement legally by putting it into writing. Any decisions made during mediation are not legally binding until this agreement is confirmed and signed by both parties.
