How does No Win No Fee work?
Sometimes more formally known as a conditional fee arrangement or CFA, a no win no fee agreement does just what the name suggests.
If you win a case, the other side pays most if not all of your basic legal costs and other costs incurred by your solicitors such as court costs and costs of getting medical reports.
When you win a case using a no win no fee agreement, both your solicitor’s fees and their costs (known as disbursements) are usually paid by the losing side. Any costs which can’t be recovered from the losing side are normally covered by a special insurance policy. If on the other hand your solicitor loses the case, then he or she doesn’t get paid.
Your solicitors are taking a risk about winning your case when taking it on under a no win no fee arrangement. Why? Because under a No Win No Fee Agreement, if you lose your case through no fault of your own, your solicitor will not be paid, and that’s why they will usually receive what is known as “a success fee” on top of basic fees (at rates set by the County Court) if your compensation claim is successful. The success fee is an additional fee for taking the risk on not being paid at all.

Making your no win no fee claim – what will happen?
At your first interview, your solicitor will try to give you an initial view of whether your accident compensation claim is worth pursuing. At that stage, it’s often not possible to give a definite answer as to whether or not your claim will be successful. At the beginning of most claims, far too little is known – and in particular it would be unusual for people starting off a claim to have cast-iron evidence supporting their case from an expert medical witness on day one.
As mentioned above, time limitation periods apply and it is often easier investigating your compensation claim if you take early legal advice. It is therefore essential that you contact a ‘no win no fee’ solicitor as soon as possible after your accident or injury.
A number of costs are payable during a compensation claim case. These include what are sometimes referred to by solicitors as disbursements – that is simply an alternative word for those fees incurred by your solicitor in preparing your case. These include getting hold of expert medical reports and may include instructing a barrister, for example. These can all prove expensive, but a solicitor may well delay billing for these expenses until the end of a case. If compensation claim is successful, you can claim those costs from the opposing side.
The most important part of your case will be pulling together all the evidence to prove that your injuries were a direct result of the actions or failure to act of the defendant – and in addition that the defendant owed what is known as a a duty of care towards you. Critical evidence will include medical reports on your injuries, and the impact those injuries may have on you in future.
