Hampshire’s Specialist Jointly Accredited Lawyer/Mediators
Family mediation, along with collaborative law, are two approaches to resolving the many issues involved in relationship breakdown and divorce – with dignity and less confrontation and bitterness. Here at Hampshire solicitors, Bonallack and Bishop, we champion these positive and highly effective approaches for those family law clients who are happy to try placing co-operation before fighting the matter out of court.
Our expert divorce and family law team include trained and accredited collaborative lawyers and jointly qualified family lawyers/mediators.
What is family mediation and how can it help me?
In situations where a divorce or split has occurred and the two partners are unable to come to an agreement between them, family mediation can help to resolve any disagreement and enable both parties to move forward effectively and put the pain of their divorce behind them.
Family mediators will always put you and your family first and come to decisions which will help everybody as much as possible. They will enable you to plan for the future and come to an agreement without the pain and cost of having to go to court.
Put simply, it’s a far less stressful, painful and expensive way to come to an agreement acceptable by you both, and lets you to move forward far more quickly. This is particularly important if children are involved, as a quick solution in these situations will ensure that no more undue stress is caused to your children, who are going to be particularly susceptible at this time.
Mediation sessions are far less stressful than going to court as they are very informal and the outcomes are not legally binding – although there is a clear expectation that any agreement you have reached together will be stuck to. When it comes to a financial settlement, our lawyers always strongly recommend that the agreement you have reached is put into the form of a binding order for approval by the court
Mediation is also far less costly than going to court, even if you end up needing additional independent legal advice as well. The costs could be reduced even more if you are entitled to legal aid(please note we are not able to offer family mediation using legal aid).

Family mediation – how it can really help your children
One of the worst scenarios in divorce or relationship breakup is a long, drawn out court battle between parents over the rights to see a child, or to have a child live with you.
That’s normally even worse when the children are a little older and can understand more about what’s going on. In fact an essential part of the process of bringing up children is that as they grow and mature, their views become more important. So particular for those older children, it’s important that their views are taken into account and that they know they have been listened to. That’s an awful lot of pressure to put on a child at any time, especially when they’re really distressed by their parents’ breakup.
Mediation helps to make divorce proceedings less acrimonious and as a result it can help to insulate children from tensions involved. Whilst parents will need to make personal sacrifices, mediation enables them to control the outcome for their children in a way that they cannot do through court action, where a judge makes the final decision.
In contrast, using mediation, children know that their parents have worked together in their interests. And that’s really important.
For those it does suit, family mediation can make a real and significant difference to the happiness of your children.
