Your Divorce – our sensitive approach
Looking for guidance through your divorce proceedings? We’ll first try to avoid court proceedings by exploring dispute resolution options, such as mediation, collaborative law and solicitor-led negotiation. In some cases, it may be best to proceed with a court application in order to find the most beneficial outcome. But we firmly believe that divorce and family law cases are not battles to be won – but problems needing a solution.
We are all strong supporters of a non confrontational approach and believe that sorting out arrangements when a relationship breaks down doesn’t always have to be stressful. This is particularly important when children are involved, because you never need to get that although you may no longer be a relationship with your spouse or partner, both of you will always be parents to your children. That and the fact that the process can be likely to be quicker and cut costs for those involved, is why we are strong supporters of family mediation – and why, over the years, we have trained up three of our family law team as jointly accredited lawyer/mediators.

In particular, our team will always do their utmost to reach an agreeable settlement for our clients without running up enormous legal fees, which are most likely when court proceedings are involved.
Picking the right divorce solicitor for you
Britain has one of the highest divorce rates in Europe, and you won’t be surprised to hear that there are many solicitors looking for divorce work. So how do you pick the right one?
o Choose a specialist. Many solicitors still dabble in numerous areas of law. But you want to make sure that the solicitor you choose is a family law and divorce specialist. Rest assured that all of our family team are specialists – divorce and family work is all they do.
o Choose a solicitor you feel comfortable with. Going through divorce is not only highly emotional, but often involves discussing very personal information. You need to make sure that your solicitor is aware of all relevant facts – and to do that, you must make sure that you feel comfortable talking to them
o Choose a solicitor who listens – every divorce is different and you need to be certain that your solicitor fully understand your position, how you want to approach to divorce, and what kind of financial settlement you can live with
o Choose a solicitor who understands that divorce and family breakdown is a problem that need to be solved – not a battle that needs to be won
o Before appointing your solicitor, have an initial chat with them on the phone and see if you feel that they offer the right approach – and ask for an initial face to face appointment with them to see if they are a fit for you both personally and professionally. Our team offer free initial phone advice, and a no commitment, no strings attached FREE first 30-minute interview.
Divorce and your children
The online parenting organisation, Netmums, conducted a survey a few years back about the actual effects of their separation on children. Getting on for a third of under 18s who were surveyed said that they were ‘devastated’ by their parents divorce.
Regardless of whether you are married or not, if you are going through a relationship breakdown and you have children, it’s absolutely critical to get the best outcome, in the circumstances, for those children.
That’s why you need an experienced and sympathetic family lawyer – to explain your position and if necessary, help you negotiate reasonable set of arrangements for the children. If you’re struggling to agree, and many couples do, then court should be the absolute last resort. Family mediation is often a much better solution.

Divorce and relationship breakdown – how are family finances divided?
Of all the issues that follow relationship breakdown, financial issues are usually the most complex and take the longest to settle.
When going through a divorce, all family assets – such as pensions, savings, property, and investments – must be taken into account. That requires both sides providing a full breakdown of of their assets in what is referred to as “full and frank disclosure”.
And our solicitors always encourage parties in a divorce to try to negotiate a settlement they can both live with – and to avoid a formal application to court. That normally increases costs significantly, adds delay to the whole process, not to say introducing a considerably increased amount of stress. And in the vast majority of cases, when a settlement has been reached, to safeguard both sides, solicitors will ask the court to formalise that agreement in the form as what is known as a clean break order – which ensures the end of the matter and in general terms preventing either party from reopening that settlement.
To make sure you get the right financial settlement, it’s important that you choose solicitors who specialise in divorce and financial issues. Our team do.
